How Mediation Usually Works in a Maryland Divorce or Custody Case
Maryland family courts send a large share of divorce and custody disputes to mediation before or alongside trial scheduling. Mediation is structured negotiation with a neutral facilitator, not a trial in a smaller room.

What mediation is
You and the other side (usually with lawyers) trade written or verbal proposals through a mediator. The mediator may meet with everyone together at the start, then split into separate rooms for much of the day. The mediator’s job is to help people test options and reality-check gaps, not to decide who wins.
If you reach terms, counsel drafts language for signatures or for the court. If you do not reach terms, the case stays on the litigation track.
Waiting, offers, and partial agreements
Long stretches of waiting are normal. The mediator often carries numbers or parenting ideas between rooms. Offers move in steps: custody schedules shift, then holidays, then support, or the reverse. Sometimes parties resolve only part of the case and leave one or two issues for a judge. Partial agreements still narrow the trial and can lower cost and stress.
Why cases settle
People settle when the range of likely court outcomes overlaps enough that a written deal feels better than going to trial without a written agreement. Children, work schedules, housing, and tax effects all feed that math. Settling also gives a private day in conference rooms instead of testimony on the record.
Why cases sometimes do not settle
Some gaps are too wide, or one side believes the facts will look very different in court. Safety concerns, deep distrust, or disputes over relocation can be hard to paper over in one session. A failed mediation day is not a failure of preparation; it often means the case needs a judge’s decision on specific issues.
